SB 100: Just another SNAFU? Or Not Wasting a Crisis

I have been involved in the election integrity battle for over 20 years as a researcher, as a national speaker, as the producer of a documentary, and even as a victim in a statewide race in Nevada. This interest leads to hours of reading, especially the latest developments in elections.

SB 100 a piece of legislation introduced by Nevada Senator Skip Daly, proposes to ensure timely execution of election responsibilities but in reality it concentrates power in the hands of the Secretary of State and the Attorney General. SB 100 has the potential to centralize election duties under the control of the Secretary of State and, in certain cases, the Attorney General. The bill gives the Secretary of State sweeping authority to override decisions made by locally elected officials, such as county clerks and city clerks and even County Commissioners.

SB 100 states if a public official (e.g., county clerks, city clerks, or registrars of voters) is unable to meet the deadlines set by election laws, the Secretary of State will petition the district court to relieve the public officer of their duties and take over the responsibilities himself. If the Secretary of State fails to act, the Attorney General can take legal action to assume the duties. Furthermore, if neither the SOS nor AG steps in, any registered voter can file a lawsuit requesting the appointment of a special master to oversee the election duties. Those who are convicted are guilty of a category E felony, up to four years in prison and fines up to $5,000. This penalty is also applicable to public officers who neglect their duties or perform them in a manner that hinders the goals of the election process. There is no specific definition of neglect or hinders or grace regarding reasons for failures to meet deadlines making this legislation arbitrary and ambigous.

This overreach by the executive branch, effectively strips power away from elected officials at the local level and could potentially exert undue influence over local elections. The possibility of bypassing local officials and allowing the SOS or AG to step in and take over duties is weaponization of those offices and lawfare at its most blatant. It opens the door for legal battles that could lead to delays, confusion, and interference in the election process. The heavy reliance on the judicial system hands the court a blank check to completely bypass elected representatives. This bill seems to make a crisis out of what the present Secretary of State classified as merely a SNAFU.
