SB100 Election Take Over by SOS And AG

I have been involved in the election integrity battle for over 20 years as a researcher, as a national speaker, as the producer of a documentary, and even as a victim in court, I have firsthand experience against Harry Reid unlike my opponent who served as an apprentice of Harry Reid and the Reid Machine. This interest leads to hours of reading, especially the latest developments in elections.

The Real Danger To Freedom in SB100

This is part 2 of the real danger to freedom in SB 100 a piece of legislation introduced by Nevada Senator Skip Daly concentrating power in the Secretary of State and the Attorney General and potentially centralizing election duties under their control to override decisions made by locally elected officials. SB 100 states if a public official (e.g., county clerks, city clerks, or registrars of voters) is unable to meet the deadlines set by election laws, the Secretary of State petitions the district court to relieve the public officer of their duties and take over the responsibilities himself. If the Secretary of State fails to act, the Attorney General can assume the duties. Those convicted are guilty of a category E felony, up to four years in prison and fines up to $5,000. This penalty also applies to public officers who neglect their duties or perform them in a manner that hinders the goals of the election process. So what is the motivation behind this government overreach?

One example is Cari-Ann Burgess, former Washoe County registrar, found herself at the center of harassment, threats, and public vitriol. “While out at a local coffee shop, one woman approached her and told her she should be "ashamed" of herself and "crawl into a hole and die." “Burgess told The Associated Press in an interview that she had refused personnel changes sought by the county manager’s office and had offered to step down and return to her prior position as deputy. She said she was told that was not possible. In a meeting with county staff, including representatives of the district attorney’s office, Burgess said she was forced to put a request for leave in writing despite her desire to stay. “I feel like I was absolutely forced out, but I have no idea how we got to this point,” Burgess said in her first public remarks since her departure. “Because the previous Friday and Monday, before I was put on leave, I was having high praises. They were like, ‘You’re doing a great job, you‘ve got this, you’re the best person for this job because you brought this team together.’ “And then all of a sudden, I was out on leave.” Burgess was the fourth person in four years to hold the position of registrar of voters.

Or three Washoe County Commissioners— Michael Clark, Jeanne Herman, and Clara Andriola —refused to certify the results of 2024 Primary Election. Commissioner Clark expressed concerns about the "mismanagement" of elections. The Secretary of State and Attorney General threatened the Commissioners. “Certifying elections is simply a clerical duty with no discretion about how to vote, according to the Nevada secretary of state's office.”… Nevada Secretary of State Cisco Aguilar, a Democrat, said he was shocked the commissioners refused to certify but was prepared. He told NPR he had prefiled legal documents and then just filled in the specifics of the case. "I call it our 'Mad Libs,' " Aguilar said…Nevada Attorney General Aaron Ford filed suit against the three commissioners who voted against certification. A week later, at a commissioners meeting, Clark and fellow Commissioner Clara Andriola changed their votes to certify… "I have been told that a failure to vote to certify this election can subject me to criminal prosecution and forfeiture of office," Clark said during the meeting. "As such, my vote today is being made under extreme duress."Alexis Hill, chair of Washoe County's Board of Commissioners, is a Democrat who voted to certify the election. She said the Nevada attorney general's lawsuit "was embarrassing, but it was good.”

Or the underlying motive for the SB 100 power grab as national precedent setting legislation. “Nikhel Sus, deputy chief counsel with Citizens for Responsibility and Ethics in Washington, sees the Washoe case as an encouraging sign for the nation as voting in the 2024 election ends today. He said it shows that attorneys general have the will and tools to ensure certification. … Sus said. "These efforts [to not certify] are not going to work. They have not worked historically, and they aren't going to work this time."…State Sen. Skip Daly, a Democrat who represents a part of Washoe County, said he is certain people will challenge the results in court. "Will it result in some lawsuits that I believe will ultimately be dismissed?" Daly said. "Absolutely!" (Citizens for Responsibility and Ethics in Washington website says “At CREW, we use aggressive legal actions, in-depth investigations and innovative policy and reform… On Donald Trump’s first full day in the Oval Office in 2017, CREW sued him for violating the Emoluments Clauses of the Constitution.)

By combining these not so hidden elements — political disputes, election certification battles, public harassment, and external pressure from politically motivated groups — the possible revenge narrative becomes clearer. The power grab, in this case, was not just about controlling the mechanics of local elections but also about undermining those who challenged the shifting political landscape.
